With the implementation of Real Estate (Regulatory and Development) act-2016 (RERA) in the state of Uttar Pradesh, the registration of property will be executed on the basis of carpet area against the ongoing registration in which property registration is executed on the basis of carpet areas and super areas.
Expert says that an individual buyer will breathe some relief as he will have to deposit registration charge of areas that are within four walls of the homes while registering properties with the registrar of stamp and duty. This much portion of home of a particular housing complex will be registered in the name of individual home buyer.
But will it create problems for individual owner in the long run is an issue which needs clarification from the ruling BJP government in the state. Though it is necessary for each individual to participate in the formation of residents’ body of the apartment under the RERA but sometime residents’ body don’t give chance to an individual to be member of the body. In such cases, it leaves scopes of confrontation in the longer run.
According to RERA notified by the government, it says that the registration of a flat should be carried out on the basis of carpet areas of a particular flat. An expert says that it means an individual home buyer need not register balcony of his house which comes under super areas.
As per Mukul Singhal, Chairman of Real Estate Regulatory and Development authority in the state, who told that registration of remaining open areas and common areas will be executed with residents welfare association of the apartment or society according to the new rules. He was in Noida recently for meeting with developers of private housing complexes.
This is where a question arise which need to be answered by the government, pointed out a senior officer with the department of registration and stamp in the city.
He said, “Though we have written to the government seeking guidelines for execution of registration of property under RERA which says the flat registration is on the basis of carpet area. We are yet to receive a response from the government of the letter sent on November 6 which is regarding registration of property under the new act.”
The officer pointed out that when a residents’ body is controlled by a bunch of unscrupulous members and they don’t want to vacate the office of the body, one cannot depend on them for fair business. He said, “Flat owners will have to depend on the mercy of residents’ body members whether they allow them to use the common space or not. It is because they are going to be owner of the property.”
In the past several residents’ body have not had a healthy relation with their fellow members. It has led to split among them leading to the formation of another similar body in a particular society. The creation of other resident body will lead to unforeseen confrontation. These are some of the issues which needed to be answered.
