New Delhi: A month after adjudicating officers was appointed, the Uttar Pradesh Real Estate Regulatory Authority (UPRERA) has seen steep rise in number of complaints being lodged against private housing project developers in the state.
Maximum numbers of complaints were moved by home buyers and their associations to UPRERA are from Noida and Greater Noida in Gautam Buddha Nagar. These complaints are different nature including delayed of possession of homes, pending registration of sold properties with department of stamp and registration.
Abrar Ahmed, Secretary of UPRERA, who is also adjudicating officer for Noida and Greater Noida, said, “We have received a total of 900 complaints against housing project developers operating in the state. Maximum complaints are from Noida and Greater Noida. Around 600 individual home buyer or buyers association have registered complaints against their respective project developers.”
He explained that under the SOP, there is provision to dispose the complaint within one and half month from complaint registration. He said, “On receiving complaint, the authority has been severing notice to the projects developers. They are told through the notice that they would have to respond the complaint within said time. The meter is heard in three different given dates within which it is solved.”
He said that over 2200 housing projects are registered with the authority. The authority had in the recent past put penalty against 400 builders for non compliance of the RERA act. They paid penalty.
He said that steps are being taken to catch those private housing project developers who have been committing their home buyers and investor a new long duration deadlines. He said that there is provision under which project registration can be cancelled if the authority finds the developers have furnished incorrect information for fixing a new deadline for delivery of homes to buyers.
In a related development, the Uttar Pradesh Real Estate Regulatory Authority (UPRERA) has speed up the process of drafting clauses for sales agreement, which is inked between a home buyer and housing project while booking property. It invited suggestion from CREDAI, the body of real estate developer on Tuesday.
MukulSinghal, principal secretary, housing and chairman of UPRERA, said that they are in the process of finalizing the draft for agreement to sales. For this, they called a joint meeting of concerned authorities, developers and buyer as well.
He said that there are several points on which project developers and representative of home buyers have made suggestions to the authority. These suggestions will be incorporated while clauses will be finalized for agreement to sales draft. He said, “Once it will ready, it will put in public domain.”
There were disagreements over registration of property either on the basis of carpet areas or super areas. Currently, the registration of property in Noida and Greater Noida is being executed on the basis of super areas, which is restricted in the RERA act.
CREDAI insisted the government that when RERA act allows home buyers to execute the property registration on the basis of carpet areas, how the registration of super areas will be carried out with department of stamp and registration.
Singhal said that registration of property has to be executed in accordance to the RERA act which says registration will be done on the basis of carpet areas. He said that if the super areas are unregistered, residents’ body of the housing complex will execute the registration as it is common among them.
