AAP govt abusing legislative privileges to “brow beat” bureaucrats

New Delhi:   • House committees cannot give direct instructions to officers in day-to-day functioning   • Privilege Committee will have to specify which privileges have been violated by the bureaucrats   The Delhi Assembly’s decision to hand over the inadequate de-silting of drains issue to Privilege Committee has raised eyebrows. Experts argue that this is an act of protecting the PWD Minister Satyender Jain and targeting “law abiding” bureaucrats.

This kind of collision may lead to collapse of the government, in whichcase AAP would tryto emerge as a circumstantial victim. This is thus another desperate effort by AAP to win the sympathy of its supporters to remain afloat in city politics.

  An expert of Legislative matters, S K Sharma said that according to Transaction of Business Rules (TBR), Minister is the head of the department. But the petitions committee, instead of questioning the Minister or advising the minister, grilled the Chief Secretary MM Kutty and the Principal Secretary (PWD) Ashwani Kumar time and again. Any House Committee cannot give orders to officials on day-to-day functioning. So the House Committee was acting beyond defined boundary of TBR.

  According to S K Sharma, House Committee can summon any officer only when the concerned officer has indulged in misbehavior or hurled abuses. Now, when the issue has been sent to Privilege Committee, this committee has to explain what privileges have been violated by the officers. Having taken the top two bureaucrats MM Kutty and Ashwani Kumar in its ambit, the Privilege Committee needs to explain the violations made so far by these officers. Otherwise, the violation of TBR will give opportunity to top bureaucrats to approach the Delhi High Court.
